This case involved claims by a driver and a passenger allegedly struck in the rear by the Defendant, although Defendant asserted Plaintiff improperly passed Defendant on the right side. Defendant also asserted this was a minor accident as depicted by the photograph of the rear of Plaintiffs’ vehicle. Both Plaintiffs claimed personal injury, mostly to the cervical spine. In addition, the Plaintiff passenger asserted was loss of approximately $55,000.00 and emphasized a lack of prior injury. Conversely, the Plaintiff driver had several prior claims where he claimed similar injuries. Ultimately, with the diligence of all involved, both cases resolved amicably.
