The was a premises liability action where Plaintiff alleged he fell and was injured as a result of a defective (unlevel) area of the entryway to a business. Defendant argued, in part, that the deviation was de minimis, merely 1/2 inch, and in an area where Plaintiff had routinely entered the business. Plaintiff sustained various lacerations as well as a significant hematoma to his right thigh which required surgery. He also presented special damages of approximately $41,000.00. The photographs of Plaintiff’s injuries, particularly the hematoma, were impactful and played a significant role brokering a settlement. Another great settlement.
