Philadelphia Settlement at Mediation: $60,000.00

I recently settled a disputed premises liability claim brought by a Plaintiff who fell outside a Philadelphia business. Plaintiff was exiting the business and fell due to the presence of a step down onto the sidewalk which she asserted was deceptively level with the surrounding pavement. While likely accurate, video footage captured the incident and confirmed Plaintiff walked right between two (2) signs which warned “watch your step” before falling. In addition, Plaintiff acknowledged entering the premises in the same location where she later fell. Notwithstanding, Defendant also recognized that the paint used on the pavement and sidewalk was not compliant with local codes. With Plaintiff sustaining a fractured left elbow and left foot, both Parties recognized the benefit of settling rather than proceeding to trial.
